Article 6 – The Role of an Administrative Scrivener

We know how complex this is. But who do you actually turn to?

Articles 1 through 5 have covered which country’s law applies, what to do immediately after a death, what happens to Japanese bank accounts, who the heirs are, and how assets in Japan and overseas are handled.

The complexity is now clear. But in practice, who handles what — and who should you contact?

In Japan, legal procedures are carried out by nationally licensed professionals known collectively as shigyō — specialist practitioners whose scope of work is defined by law. Several different types are involved in inheritance matters. This article sets out who does what, so that you can make an informed decision about who to approach.


1. The full picture: who handles what

The main categories of inheritance-related procedures, and who carries them out, are as follows.

Preparing a will

Administrative scriveners, judicial scriveners, and attorneys can all assist with will preparation. There are three legally recognised forms of will in Japan, but in practice two are most commonly used: the holographic will and the notarised will.

A holographic will (jihitsu shōsho yuigon) must be written entirely by hand by the person making it. Since 2020, it can be deposited with the Legal Affairs Bureau for safekeeping, reducing the risk of loss or tampering. A notarised will (kōseishōsho yuigon) is prepared at a notary public office with the involvement of a notary, carries a high degree of legal reliability, and is held in the original at the notary’s office. Professionals assist with drafting the content, preparing the document, and supporting the notary office process.

Inheritance registration (transfer of real estate title)

This is handled by a judicial scrivener (shiho shoshi). Since April 2024, inheritance registration has been a legal obligation and must be completed within three years of learning of the death.

Preparing a deed of estate division

Administrative scriveners, judicial scriveners, and attorneys can assist with drafting. Where all heirs are in agreement and there is no dispute, an administrative scrivener or judicial scrivener can handle the matter. Where inheritance tax is payable — which applies to around one in ten estates — a tax accountant (zeirishi) may also be involved in discussions about how the estate is divided.

Disputes and Family Court proceedings

Where heirs cannot reach agreement, it is possible to apply to the Family Court for mediation (chōtei) or adjudication (shinpan). Individuals can make the application themselves, but the process is complex, and engaging an attorney provides legal support and representation throughout.

Residence status matters

When a foreign national dies, the residence status of surviving family members may be affected. Administrative scriveners are the main practitioners handling applications to change or renew the residence status of a spouse or other family members left behind.

Procedures in the home country

Procedures in the home country — such as transferring title to real estate or closing bank accounts in the UK, US, or Australia — require compliance with local law and must be handled by professionals qualified in that jurisdiction.

We support applications to change or renew the residence status of family members left behind after a death.

Coordination with home country professionals

Where home country procedures are required, we can coordinate with local attorneys and specialists. We act as the bridge between Japan-side and home country procedures running in parallel.


3. Why it matters to act early

Inheritance procedures in Japan carry strict deadlines. Three months for renunciation of inheritance. Ten months for inheritance tax filing. Three years for inheritance registration. All of these countdowns begin from the date of death.

But starting to act only after a death occurs may already be too late.

Taking stock of assets, preparing a will, establishing a connection with professionals who can handle home country procedures — all of these are most effective when done in advance. Waiting until the need arises is the one thing that consistently makes an already difficult situation harder.

A will, in particular, is not something to think about when the time comes. Preparing one while you are well and able is one of the most practical things you can do for the people you will leave behind. In Japan, estate administration for foreign nationals involves a great deal of paperwork and time. A single will can make an enormous difference to that burden.


You don’t have to navigate this alone

第6回:行政書士に何ができるのか?——専門家の役割分担を整理する

複雑さの全体像が見えた。では、誰に頼めばいいのか

第1回から第5回にかけて、準拠法の問題、死亡直後の手続き、銀行口座の凍結、相続人の確定、そして日本と海外の資産をどう処理するか——これらを順に見てきました。

手続きの複雑さは、ご理解いただけたと思います。では実際に、誰に何を頼めばよいのでしょうか。

日本では、法律に関わる手続きは「士業」と呼ばれる国家資格者が担います。相続に関わる手続きには複数の士業が関係しており、それぞれ担当できる業務の範囲が法律で定められています。この記事では、読者の皆さんが「誰に何を相談すればよいか」を判断できるよう、役割分担を整理します。


1. 手続きの全体像:誰が何を担うか

相続に関わる手続きを種類ごとに整理すると、以下のとおりです。

遺言書の作成

行政書士・司法書士・弁護士がサポートします。遺言書には法的に3種類ありますが、実務上使われるのは自筆証書遺言と公正証書遺言の2種類です。

自筆証書遺言は自分で全文を手書きする形式です。2020年より法務局での保管制度が始まり、紛失・改ざんのリスクを防ぐことができます。公正証書遺言は公証役場で公証人が関与して作成するもので、法的効力が高く、原本が公証役場に保管されます。専門家は遺言の内容の相談・原案の作成・公証役場での手続きのサポートを担います。

相続登記(不動産の名義変更)

司法書士が担当します。2024年4月より相続登記が義務化されており、相続を知った日から3年以内の登記が必要です。

遺産分割協議書の作成

行政書士・司法書士・弁護士が作成をサポートします。相続人間に争いがなく、全員の合意が得られている場合は行政書士・司法書士が対応できます。相続税申告が必要な場合(相続全体の約1割)は、税理士も遺産分割の内容に関与することがあります。

相続に関する紛争・家庭裁判所での手続き

相続人間で合意が得られない場合、家庭裁判所への調停・審判の申立てができます。本人が申立てを行うことも可能ですが、手続きが複雑なため、弁護士に依頼することで法的なサポートを受けることができます。

在留資格に関わる手続き

外国人が亡くなった場合、残された家族の在留資格に影響が生じることがあります。配偶者や家族の在留資格の変更・更新手続きは、行政書士が主に対応しています。

本国側の手続き

本国の専門家(弁護士等)が担当します。英米豪などでの不動産名義変更・銀行口座の解約などは、現地の法律に従った手続きが必要であり、現地の専門家が必要になります。

本国側の手続きが必要な場合、現地の弁護士・専門家との連携をコーディネートできます。日本側と本国側の手続きを並行して進めるための橋渡し役を担います。


3. 早めに相談することの意味

相続手続きには、いくつかの厳格な期限があります。相続放棄は3か月以内、相続税の申告は10か月以内、相続登記は3年以内——これらはすべて、亡くなってから始まるカウントダウンです。

しかし、亡くなってから動き始めるのでは遅い場合があります。

資産の全体像を把握すること、遺言書を作成すること、本国の専門家との連携ルートを確保しておくこと——これらはすべて、生前に準備しておくことで初めて意味を持ちます。

特に遺言書については、「必要になってから考える」ではなく、「元気なうちに作っておく」ことが、残された家族への最大の贈り物になります。日本では外国人の相続手続きに多くの書類と時間がかかります。遺言書一枚が、その負担を大きく変えます。
